My Rideshare Driver Got Into an Accident and I was Injured
Using services such as Uber and Lyft has become a very common way to get around. These rideshare services offer a form of convenience that taxi cabs and public transportation generally can’t offer to riders. Unfortunately, the screening of Lyft and Uber drivers is often not the greatest, and even if they are properly screened, accidents can happen!
Given the ubiquity of ridesharing (there are estimated to be one million Uber drivers in the U.S.!), it is not uncommon for accidents with ridesharing drivers to occur. If you are a passenger in a ridesharing vehicle, you are entitled to make a claim for damages you suffer, including medical bills, pain and suffering, and more. For pedestrians and for drivers of other vehicles (if the rideshare driver is at fault), claims for bodily injury and medical expenses, pain and suffering, and property damage may also be pursued.
Rideshare Insurance Coverage
What you may not know is that rideshare companies provide drivers with additional insurance coverage to protect against accidents – this coverage is valid for when a driver is directly at fault or if a rider, pedestrian, or other driver is injured in an accident with a rideshare driver. Lyft’s and Uber’s insurance for drivers begins coverage when a driver is either available or waiting for a ride request or when they are en route to pick up a rider and during a trip with a rider. When a rider is in the car, the insurance policy for Lyft and Uber drivers covers up to $1 million in third-party liability and has uninsured/underinsured motorist coverage for covered accidents. This means that even if the other driver is at fault for causing the accident, you will have at least $1 million in coverage for the loss available.
Who is At-Fault?
A major point often debated after car accidents is who is the at-fault driver. This means figuring out who caused an accident to occur. In cases where there is some question as to who caused the accident, your lawyer will work with the insurance companies of both vehicles to determine who is responsible for causing the crash.
What to do after a Lyft or Uber Accident?
If you have been in an accident while riding as a passenger in Uber, Lyft, or any other rideshare service, it is important that you reach out to an attorney as soon as possible. Make sure that you do not accept any settlement offers from those companies or their insurance carriers until you have spoken with an attorney. If possible and safe to do, try to document as much of the scene of the accident as possible. Ask for the names and addresses of both drivers. If they refuse to provide information, you can request that the police be called to the scene to facilitate an exchange of information. Photographing the accident scene, the damage to both vehicles, and documenting any injuries is very important. If you require a trip to the emergency room or a doctor, keep all records of those visits. Always report the accident through the rideshare app.
